Terms and Conditions
This agreement outlines the terms and conditions for the annual photography retainer provided by Rosie Peacock Photography (“Photographer”) to the client (“Client”). By booking the annual photography retainer, the Client agrees to the following terms:
1. Retainer Description
• The annual retainer includes 4 photoshoots per calendar year.
• Each photoshoot has a maximum duration of 3 hours.
• Shoots may be combined into longer sessions (e.g., two 3-hour shoots combined into one 6-hour shoot), but this must be agreed upon in advance.
2. Scheduling
• Photoshoots must take place within the calendar year of the retainer agreement.
• Unused shoots cannot be carried over to the following year and will be forfeited without refund.
• Photoshoots may be scheduled at any time during the year, subject to the Photographer’s availability.
3. Location
• All photoshoots must take place within Norfolk, England, unless otherwise agreed in writing. Additional fees for travel outside this area may apply.
4. Rescheduling and Cancellations
• Client Rescheduling: The Client must provide at least 7 days’ notice to reschedule a shoot. Rescheduling is subject to availability.
• Photographer Rescheduling: In the unlikely event the Photographer needs to reschedule, the Client will be notified as soon as possible and an alternative date will be arranged.
• Cancellations: If the Client cancels a shoot with less than 7 days’ notice, the shoot will be considered completed and deducted from the retainer.
5. Deliverables
• The Photographer will provide a set number of professionally edited images per shoot (specifics to be detailed in the project brief or agreed in advance).
• Images will be delivered in digital format via an online gallery hosted on Pictime.
• The Client will have lifetime access to their gallery through Pictime. It is the Client’s responsibility to download and back up images, as lifetime access is contingent on Pictime’s service availability.
6. Usage and Licensing
• The Client will receive a non-exclusive, non-transferable license for personal and/or business use of the images.
• The Photographer retains copyright and ownership of all images.
• Images may not be edited, cropped, or altered without the Photographer’s permission.
7. Payment Terms
• The total fee for the retainer must be paid upfront or in accordance with an agreed payment plan.
• Retainer fees are non-refundable.
• Any additional services (e.g., extra shoots, extended hours, additional edits) will incur additional fees, payable prior to or at the time of service.
8. Liability
• The Photographer is not responsible for any circumstances beyond their control, such as weather conditions, venue restrictions, or Client delays, that may impact the photoshoot.
• The Photographer’s liability for any claims, including negligence, is limited to the amount paid under this agreement.
9. Force Majeure
• In the event of unforeseen circumstances such as natural disasters, illness, or other emergencies, the Photographer reserves the right to reschedule or cancel the shoot with notice. Refunds will not be issued, but alternative dates will be provided.
10. Model Release
• By entering into this agreement, the Client grants permission for the Photographer to use images for portfolio, marketing, and promotional purposes unless the Client requests otherwise in writing before the shoot.
11. Agreement and Modifications
• This agreement constitutes the entire understanding between the Photographer and the Client.
• Any modifications must be made in writing and signed by both parties.
